If your limited company owns a vehicle which it relies upon, and it is written off unexpectedly, replacing it will likely be the immediate priority. What many business owners do not realise, however, is that choosing the wrong replacement vehicle can have significant tax consequences for both them and their business.
This was the situation faced by our client Jonny. After an accident left him without his company vehicle, Jonny quickly bought a replacement so he could continue running his business. However, the vehicle he chose was treated significantly differently for tax purposes compared to his previous vehicle, creating less favourable tax relief and a higher ongoing personal tax charge.
Fortunately, as the business was being advised by Client Portfolio Manager, Jordan Cooper, the purchase of Jonny’s replacement car was identified within six weeks, meaning the decision and ultimately the tax consequences of the decision could be discussed with the client, and a more tax efficient alternative suggested.
What was the client’s situation?
Jonny owns a limited company and has been a client of Cooper Associates Accountancy since 2018. As a business owner, Jonny regularly travels between various properties and client meetings, making a vehicle essential for the day-to-day running of the business.
In 2023, Jordan worked with the client to better understand Jonny’s requirements for a company vehicle leading to a discussion about various options available, as well as the method in which Jonny could purchase the vehicle for tax efficiency in the company but also Johnny personally.
However, when that vehicle was unexpectedly written off in early 2026, Jonny understandably focused on getting back on the road quickly and involving his accountant did not seem the priority.
Johnny didn’t consider at the time that the replacement vehicle did not qualify for the same tax treatment as the previous vehicle and would give rise to a greater benefit-in-kind tax charge on him personally for his personal use of the vehicle.
Jordan explains:
“Like many business owners would, Jonny’s first priority was simply replacing the vehicle and getting back to work. The challenge was that the replacement vehicle changed the tax position significantly.”
Why this mattered
Without a review, Jonny could have found himself running a vehicle through his company that was no longer tax efficient. This was because the replacement vehicle:
- Did not qualify for the same capital allowance treatment as the previous vehicle, which had restricted the tax relief available to the business.
- Would have resulted in tax relief being spread over a much longer period rather than claimed upfront in the same tax year, potentially affecting cashflow.
- May have created an ongoing Benefit in Kind charge if the vehicle had been owned by the company and used personally due to the type of vehicle and the emissions of that vehicle.
- Could have led to additional personal tax implications if private fuel continued to be paid for by the business.
Fortunately, as this was picked up early following a review of the company bookkeeping, Jordan was able to support Jonny before the purchase created long-term tax consequences for him and his business.
Why the tax position changed
Although both vehicles were used for business purposes, they were treated differently under tax rules because the original double cab pickup qualified for more favourable capital allowance treatment as it met the relevant criteria at the time.
Jordan explains:
“Capital allowances are a form of tax relief that allow businesses to deduct the cost of qualifying assets from their taxable profits. However, the level and timing of relief available depends on factors such as the type of asset purchased.
The original vehicle qualified for significantly more generous relief because of the way it was classified for tax purposes.”
The new vehicle did not qualify for 100% capital allowances in the year of acquisition, and as such, tax relief would have been spread over a much longer period, reducing the immediate tax benefits available to the business and affecting cash flow expectations.
The replacement vehicle also introduced another important consideration.
If the company owned the vehicle and Jonny used it personally, this would give rise to a Benefit in Kind tax charge.
“A Benefit in Kind charge is a tax charge that applies when an employee or director receives a personal benefit from their company, such as the private use of a company vehicle. The taxable value of that benefit is added to their income and taxed accordingly, creating a personal tax liability even though the vehicle is owned by the business.”
For Jonny, this meant the replacement vehicle had the potential to create ongoing tax implications of him personally that he had not been aware of.
The solution
After reviewing Jonny’s circumstances, Jordan recommended that the replacement vehicle was bought from the company to be owned personally, with Jonny claiming mileage for eligible business journeys instead. Johnny bought the vehicle from the company at the same price it was bought for to avoid any tax implications of the transfer.
Jordan explains:
“We reviewed the vehicle Jonny had chosen and based on the tax treatment of that vehicle, it made more sense for him to own it personally and claim mileage for his business journeys instead.
While this did mean a little more administration because Jonny would need to keep a record of his business mileage, the tax savings and prevention of the ongoing Benefit in Kind charge made it the more suitable option overall.”
Under the revised structure, vehicle costs such as insurance, repairs and maintenance would be covered personally, while business mileage could be claimed at HMRC’s approved mileage rates for qualifying journeys.
Most importantly, the ongoing Benefit in Kind charge that would have arisen under a company-owned arrangement no longer applied, which was more cost effective and tax efficient for both the company and Jonny.
The outcome
By identifying the issue within weeks of the purchase, Jordan was able to review the available options with his client and implement a more suitable arrangement before it created ongoing tax consequences for Jonny and his business.
The support provided helped Jonny:
- Not incur a recurring, high, Benefit in Kind charge.
- Not be subject to an additional personal tax liability.
- Continue claiming business mileage for qualifying business journeys.
- Gain clarity and confidence that his vehicle arrangements continued to support both his business and personal needs.
- Understand the wider tax implications of future vehicle purchases.
Importantly, the value to the client was not just in resolving the immediate issue but in identifying the problem quickly and providing practical guidance when it mattered most.
The value of proactive support
This case highlights how accountancy support can often provide value beyond annual accounts and tax returns, as Jordan explains:
“By taking the time to understand Jonny’s business and maintaining regular contact throughout the year, we were able to identify the issue early, review the available options and help put a more suitable and tax-efficient structure in place for him.
While every business owner’s circumstances are different, this case demonstrates the importance of seeking professional advice before making significant financial decisions and the value in having an accountant who understands both your business and your long-term goals.”
